These Terms of Service (“Terms”) govern your use of the Society of Illustrators Competitions website and all related services, submission platforms, digital content, and features (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
1. Eligibility
By using the Service, you represent that you are at least 18 years old, or accessing the Service with the consent of a parent or legal guardian. Additional eligibility rules may apply to specific competitions and will be listed on the applicable entry page.
2. Account Registration
You may be required to create an account to submit work, manage entries, or access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
3. Submission of Artwork & Materials
By submitting any artwork, text, images, designs, or other content (“Submission”), you affirm that:
- You are the creator and copyright holder of the work, or have full legal rights to submit it.
- Your Submission does not infringe on any third-party rights, including copyright, trademark, privacy, or publicity rights.
- You grant the Society of Illustrators a non-exclusive, worldwide, royalty-free license to display, reproduce, and promote the Submission solely in connection with competition administration, exhibitions, publications, archives, and promotional materials.
4. Fees & Refunds
Entry fees, when applicable, are non-refundable except where required by law or explicitly stated in the competition rules. Failure to complete entry requirements, submit correct files, or comply with deadlines does not qualify for a refund.
5. Judging & Awards
All judging decisions are final and made at the sole discretion of the Society of Illustrators and its appointed jurors. The Society reserves the right to disqualify entries that do not meet eligibility, technical, or content requirements.
6. Prohibited Conduct
You agree not to:
- Use the Service for unlawful purposes or in violation of any applicable law
- Upload malicious code, spam, or attempt to disrupt site functionality
- Misrepresent your identity, affiliation, or authorship of submitted work
- Attempt to interfere with the judging process or gain unauthorized access to judging materials
7. Intellectual Property
All site content, trademarks, graphics, and software are owned by the Society of Illustrators or its licensors and are protected by applicable intellectual property laws. No rights are granted except as expressly stated in these Terms.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. The Society of Illustrators does not guarantee uninterrupted or error-free operation.
9. Limitation of Liability
To the fullest extent permitted by law, the Society of Illustrators is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including lost data, system failure, or unauthorized access.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and handle personal information.
11. Changes to These Terms
The Society of Illustrators may update these Terms at any time. Continued use of the Service after updates are posted constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflicts-of-law principles. Any disputes will be resolved exclusively in the state or federal courts located in New York County, NY.
